TD The legal battle over the release of historical U.S. law-enforcement records relating to allegations involving President Bola Ahmed Tinubu has entered another phase.

The U.S. Department of Justice has filed fresh document, seeking additional time to respond to a federal court order concerning records held by the FBI, DEA and other Justice Department components.

The development has attracted renewed political attention in Nigeria after President Tinubu had formally joined the Justice Department’s request for additional time.

Washington-based Republican lobbying firm Von Batten-Montague-York L.C., which has worked for former Vice President Atiku Abubakar, had publicly urged the Trump administration to release the records.

The firm said U.S. Attorney for the District of Columbia Jeanine Pirro requested additional time because some of the material being prepared for the court contains information considered highly sensitive.

According to reports on the latest court proceedings, the government sought a 10-day extension.

Meanwhile, U.S. District Judge Beryl Howell has previously imposed tighter deadlines in the long-running Freedom of Information Act (FOIA) litigation.

Court Case Stems from FOIA Request

The case originated from a FOIA lawsuit filed by transparency activist Aaron Greenspan, who sought records from U.S. agencies concerning historical investigations involving Tinubu.

In April 2025, Judge Howell ruled that the FBI and DEA could no longer rely on blanket “Glomar” responses to refuse to confirm or deny the existence of responsive records.

She concluded that previous official acknowledgements had already established that Tinubu had been the subject of an investigation, making continued reliance on the Glomar position untenable.

Importantly, the court’s ruling did not determine that Tinubu committed a drug-trafficking offence.

Rather, it addressed the government’s obligations under FOIA and whether responsive, non-exempt records should be searched, processed and potentially disclosed.

Historical Allegations

The records sought relate to a 1990s investigation into a Chicago-area heroin distribution and money-laundering operation.

A 1993 civil forfeiture proceeding involved approximately $460,000 in funds linked by U.S. authorities to suspected drug proceeds.

Tinubu has never been criminally convicted of drug trafficking in the United States.

Furthermore, the forfeiture proceeding itself was civil rather than a criminal conviction.

Judge Howell’s 2025 opinion nevertheless noted that a Justice Department affidavit described probable cause to believe that funds in certain accounts controlled by Tinubu were involved in transactions allegedly connected to drug-trafficking proceeds.

Lobbying Firm Accuses Tinubu of Trying to Block Release

Von Batten-Montague-York has taken an aggressive position in the controversy.

It argued that the American public should be allowed to see records that are legally subject to disclosure.

In its latest commentary, the firm claimed that Tinubu was invoking ratione personae, or head-of-state immunity.

The firm said Tinubu is attempting to use the Nigerian state’s position to prevent publication of the records.

Those assertions should be treated as claims by the lobbying firm rather than established facts.

The president’s participation in the litigation is alleged that he is seeking to permanently suppress the records.

Reports indicate that Tinubu formally joined the Justice Department’s request for additional time in the FOIA proceedings.

Political Stakes Rise Ahead of 2027

The controversy has acquired an additional political dimension because Von Batten-Montague-York has been associated with Atiku Abubakar.

Abubakar, it should be noted, is Tinubu’s major political rival ahead of Nigeria’s 2027 presidential election.

The firm has repeatedly called on the Trump administration and Congress to release the records, arguing that the U.S.-Nigeria strategic relationship should not prevent lawful disclosure.

The renewed dispute therefore sits at the intersection of FOIA transparency, presidential privacy, diplomatic relations and Nigerian electoral politics.

What the Court Process Does — and Does Not — Establish

The current proceedings do not establish that Tinubu was convicted of heroin trafficking.

They also do not establish that every document requested by Greenspan will eventually become public.

FOIA records can remain subject to statutory exemptions, including protections relating to privacy, confidential sources, investigative techniques and other sensitive law-enforcement information.

What is established is that a U.S. federal court has ordered the agencies to process responsive records.

It has also rejected their earlier blanket refusal to acknowledge the existence of relevant investigative files.

The next stage will determine which records can legally be disclosed, what information may be redacted, and when any release will occur.

For Tinubu, the controversy represents another politically sensitive chapter in the long-running scrutiny of his U.S. financial and investigative history.

For transparency advocates, the case is principally about the public’s right to access government records through the FOIA process.
