TDThe Coalition of United Political Parties (CUPP) and several other major political parties have welcomed the landmark judgment of the Federal High Court delivered by Justice M.G. Umar, which has reshaped the electoral process ahead of the 2027 general elections.

In a united position, the parties urged the Independent National Electoral Commission (INEC) to immediately comply with the ruling by adjusting its revised timetable to align with the court’s directives.

Landmark Judgment Expands Democratic Space

The Federal High Court’s pronouncements have significantly expanded the democratic space by granting political parties greater flexibility in their internal affairs.

Among the key elements of the judgment are:

  1. Politicians who lost primary elections can defect to another party and still be validly substituted as candidates.

  2. The controversial 21-day party register requirement has been nullified.

  3. Substitution primaries are exempted from strict Electoral Act timelines.

  4. INEC cannot dictate specific dates for internal party activities or unilaterally shorten submission and publication windows.

  5. INEC cannot publish the final list of candidates earlier than 60 days before the election.

  6. Campaigns cannot be forced to end just two days before elections.

Justice Umar’s ruling effectively nullified INEC’s revised timetable for primaries, candidate submissions, withdrawals, replacements, publication of particulars, and campaign schedules.

Political Parties React

Speaking on behalf of CUPP, Acting National Chairman Chief Peter Ameh described the judgment as “progressive and constitution-aligned.”

He stressed that INEC must obey the ruling without delay.

“INEC must immediately obey this ruling and adjust its timetable accordingly.

“Any decision to appeal this judgment will only create unnecessary uncertainty, erode public confidence, and undermine the credibility of the 2027 general elections,” Ameh said.

He disclosed that 14 political parties have already resolved to announce extended internal election timetables to accommodate new entrants and ensure inclusivity in line with the judgment.

Strengthening Internal Democracy

The parties emphasized that the judgment strengthens internal democracy, promotes party autonomy, and protects the rights of aspirants and candidates.

“They argued that the ruling restores balance between INEC’s regulatory role and the constitutional rights of political parties to manage their internal affairs.

Civil society groups and political analysts have also hailed the decision as a step toward deepening Nigeria’s democratic process.

“Many believe the ruling will prevent unnecessary conflicts between INEC and political parties, while ensuring that aspirants are not unfairly excluded due to rigid timelines.

Legal and Constitutional Implications

The judgment carries significant constitutional weight. By affirming that INEC cannot impose arbitrary deadlines, the court has reinforced the principle that electoral bodies must operate within the boundaries of the law.

Legal experts note that the ruling also addresses long-standing grievances among political parties, particularly regarding INEC’s tendency to set restrictive timetables that often disadvantage smaller parties or new entrants.

Call to INEC

Political parties have called on INEC to work collaboratively with them to implement a revised, realistic timetable that reflects the Federal High Court’s clear directives.

They warned that any attempt to resist or delay compliance would undermine confidence in the electoral process and potentially destabilize preparations for the 2027 polls.

“This judgment is not just about political parties; it is about protecting democracy itself.

“INEC must act responsibly and ensure that the electoral process is inclusive, transparent, and credible,” Ameh added.

Broader Impact on 2027 Elections

The ruling is expected to reshape the political landscape ahead of the 2027 general elections.

By allowing defectors to be substituted as candidates, the judgment opens the door for greater political mobility and competition.

Analysts predict that this could lead to more dynamic party alignments and a wider pool of candidates.

Furthermore, the nullification of the 21-day register requirement and the exemption of substitution primaries from strict timelines will give parties more room to adapt to changing political realities.

This flexibility is seen as crucial in a country where political developments often unfold rapidly.

Outlook

The Federal High Court’s judgment delivered by Justice M.G. Umar has set a new precedent in Nigeria’s electoral jurisprudence.

Political parties have embraced the ruling as a victory for democracy and have urged INEC to comply immediately by adjusting its timetable.
