TDThe Federal Government has filed a three‑count charge against former Kaduna State Governor, Nasir El‑Rufai, over allegations of unlawful eavesdropping on telephone conversations.

In the suit, the Government alleged that El-Rufai unlawfully intercepted the phone communications of the National Security Adviser (NSA), Nuhu Ribadu.

The Eavesdropping Charges

The eavesdropping case, lodged before the Federal High Court in Abuja through the Department of State Services (DSS), accuses El‑Rufai of:

  1. Unlawful interception: Using technical equipment to tap into Ribadu’s calls.

  2. Failure to report: Being aware of the interception but not notifying security authorities.

  3. Endangering public safety: Instilling “reasonable apprehension” among Nigerians and compromising national security.

The charges cite violations of Section 12(1) of the Cybercrimes (Prohibition, Prevention, etc.) (Amendment) Act 2024 and Section 131(2) of the Nigerian Communications Act 2003.

Background of the Eavesdropping Saga

El‑Rufai, it could be recalled, previously served as Minister of the Federal Capital Territory under President Olusegun Obasanjo.

He hinted to his involvement in the eavesdropping during an appearance on Arise TV’s Prime Time program on February 3.

The Federal Government claims he acted alongside unidentified accomplices who remain at large.

This development comes amid heightened tensions between the Tinubu administration and opposition figures, with El‑Rufai recently at the center of controversies.

The controversies involved alleged attempts to arrest him and his petition over the importation of the toxic compound Thallium Sulphate.

The lawsuit has sparked intense debate within Nigeria’s political class.

Opposition politicians describe the eavesdropping charges as politically motivated.

Meanwhile, government supporters argue that intercepting the NSA’s communications represents a grave breach of national security.
